The short version. SwapIt is a place where people buy, sell and swap their own things with each other. We provide the app; the deal is between you and the other person. Be honest about what you list, pay and talk inside the app, meet safely, and treat people well. If you break these rules we can remove your content or your account.

1. Who we are
SwapIt is run by [Company legal name] ([Company registration number]), [Registered address] ("SwapIt", "we", "us"). These terms apply to the SwapIt app, website and everything we offer through them (together, "SwapIt").
2. Accepting these terms
By creating an account or using SwapIt you agree to these Terms of Use, our Privacy Policy and our Listing Policy. If you do not agree, please do not use SwapIt.
You must be 18 or over and able to enter a binding contract. SwapIt is for individuals trading their own items. If you sell as a business, you must say so and follow the laws that apply to traders, including consumer protection law.
3. Your account
- Give us true, current details and keep them up to date. One person, one account.
- Keep your sign-in safe. You are responsible for what happens on your account unless it was used without your permission and you told us promptly.
- Verification (for example, a phone number or a selfie check) helps others trust you. It is not a guarantee by us of who anyone is or how they will behave.
- We may refuse, limit or close an account to protect our community or meet the law.
4. What SwapIt is, and is not
SwapIt is a marketplace platform. We provide tools for people to list items, find matches, make offers, talk, pay and arrange handover. We are not the buyer or seller of any item, we do not own, hold or inspect items, and we are not a party to the contract between users, except where we expressly say we act for you (for example, handling payments through our payment partners as described in section 8).
We do not guarantee that any item is genuine, safe, legal, as described, or fit for any purpose, or that any user will complete a deal. Checks we run (including automated and AI checks) help reduce risk; they do not remove it.
5. Listing and Trade
When you list an item, or add something you have on Trade (even if it is not listed yet), you confirm that:
- you own it and have the right to sell or swap it, and it is not stolen, blocked, or subject to a claim by anyone else;
- your photos are real photos you took of that exact item, and your description is true and complete, including any faults;
- it follows our Listing Policy and the law.
We may hold a listing for checking, ask for more information, decline it, edit how it is shown (for example its category), or remove it. We may show listings and Trade items in other people's feeds, matches, search and notifications, and in places that promote SwapIt.
6. Matches, prices and suggestions
SwapIt suggests matches, estimates what things are worth, and orders what you see, using the details people give, what is listed and sold on SwapIt, how people use SwapIt, and automated tools including AI. These are guides only. A "match", "worth" or percentage is not an offer, valuation or promise, and we are not responsible for decisions you make based on them. Check the item and agree the deal yourself.
7. Offers, swaps and buying
- An offer (cash, items, or items plus cash) becomes a deal between you and the other person when they accept it in the app.
- Once a deal is agreed, both of you must complete it honestly: hand over the item as described, at the agreed time and place or by the agreed delivery, and confirm receipt when you have it.
- You can only cancel as the app allows. Repeatedly cancelling or not turning up may limit your account.
- Items offered in a swap must meet the same rules as listings.
8. Payments, fees and your wallet
- Payments on SwapIt are processed by our payment partners (such as Stripe and Paystack). By paying or receiving money through SwapIt you also agree to their terms.
- Held until checked. When you pay through SwapIt for a deal, the money is held by our payment partners and released to the other person only when you confirm you have received the item, or as set out in the app's deal steps and deadlines, or when a dispute is decided. We may hold, reverse or refund a payment where we reasonably suspect fraud, a breach of these terms, or where the law requires.
- Fees. Any fee (for example a service fee, listing credits or delivery cost) is shown before you confirm. Fees already paid are not refundable unless we say so or the law requires.
- Wallet. Money due to you may show in your SwapIt wallet until you withdraw it to your own bank account. Withdrawals may need identity checks and take time to arrive. We are not a bank and the wallet earns no interest.
- Pay inside the app. Paying or asking to be paid outside SwapIt removes the protection of held payments and is against these terms.
- You are responsible for any taxes on your sales.
9. Delivery and meeting in person
Delivery. Delivery is provided by independent courier partners (such as Fez Delivery). When you choose delivery, the courier carries the item under its own terms, and we share the details it needs (names, phone numbers, pickup and delivery addresses). We are not a courier and are not responsible for the courier's service, except as the law requires; we will help you raise a problem with them.
Meeting in person. If you choose to meet, you do so at your own risk. Meet in a busy public place in daylight, bring someone with you if you can, check the item before you confirm, and never share more personal information than you need. SwapIt's safety features help, but we cannot supervise meetings and are not responsible for what happens at them.
10. Community rules
You must not:
- list or offer anything in our never-allowed list, or anything you do not own;
- mislead people about an item, its condition, or yourself; use other people's photos;
- put phone numbers, emails, social handles, bank details or links in public places (listings, comments, profiles, Trade items) or try to move deals off SwapIt;
- harass, threaten, insult or discriminate against anyone, or send spam;
- scam, attempt fraud, use stolen payment details, or launder money;
- create fake accounts or reviews, or manipulate matches, ratings or prices;
- copy, scrape, reverse-engineer or overload SwapIt, or get around our checks or limits;
- break the law, or help anyone else do any of these things.
11. How we keep SwapIt safe
We use automated tools, including AI, and human review to check photos, listings, Trade items, profiles, messages and comments, sometimes before they are delivered or published. This can include blocking a message that shares contact details, holding a listing for review, or stopping a photo that is not of a real item. We may remove content, limit features, hold payments, or suspend or close accounts that break these terms, and we may report illegal activity to the authorities. If you think we got a decision wrong, contact us and a person will look at it again.
12. When something goes wrong
If a deal goes wrong, tell the other person through the app first. If you cannot sort it out, open an issue in the deal in the app before the deadline shown. We may look at the evidence (messages, photos, delivery records) and decide what happens to money we are holding. Our decision on held money is final as far as SwapIt is concerned, but it does not affect any legal rights you have against the other person.
13. Your content
You keep ownership of the photos, videos, text and other content you post. You give us a worldwide, non-exclusive, royalty-free licence to host, copy, adapt (for example resize or crop), analyse (including with AI), display and share that content to run, improve and promote SwapIt, for as long as it is on SwapIt and for a reasonable time afterwards. You confirm you have the right to give this licence. Content you send in messages is used only to deliver, check and support your conversations.
14. Our responsibility to you
We will provide SwapIt with reasonable care and skill. SwapIt is otherwise provided "as is" and "as available"; it may sometimes be unavailable, slow or contain errors.
To the fullest extent the law allows, we are not responsible for:
- items listed, swapped, sold or delivered, including their quality, safety, legality or authenticity;
- what other users do or fail to do, including at meetings or in deliveries;
- loss of profit, business, revenue, data or opportunity, or any indirect or unforeseeable loss;
- losses caused by things outside our reasonable control, or by your breach of these terms.
Our total responsibility to you for all claims relating to SwapIt in any 12 months is limited to the greater of (a) the fees you paid to SwapIt in those 12 months and (b) ₦50,000 (or £100 for users in the UK).
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited or excluded by law, and nothing affects your statutory rights as a consumer (including under the UK Consumer Rights Act 2015 or the Nigerian Federal Competition and Consumer Protection Act 2018).
15. Your responsibility to us
To the extent the law allows, you agree to cover our reasonable losses and costs (including legal costs) arising from your breach of these terms, your content, your items, or your dealings with other users.
16. Ending your account
You can delete your account at any time in Settings, once any deals in progress are finished and any money in your wallet is withdrawn. We may suspend or close your account, with or without notice, if you break these terms, if we must for legal reasons, or if your account is inactive for a long time. Sections that by their nature should continue (such as 13 to 15 and 18) continue after your account ends.
17. Changes
We may change SwapIt and these terms. If a change matters, we will tell you in the app or by email before it applies. If you keep using SwapIt after that, the new terms apply; if you do not agree, you can delete your account.
18. Law and courts
If you live in Nigeria, these terms are governed by the laws of the Federal Republic of Nigeria and the courts of Lagos State have jurisdiction. If you live in the United Kingdom, they are governed by the laws of England and Wales and the courts of England and Wales have jurisdiction, though if you live in Scotland or Northern Ireland you may also bring claims in your local courts. This does not take away any mandatory protection you have under the law where you live.
If any part of these terms is found unenforceable, the rest still applies. If we do not enforce a term straight away, we can still enforce it later.
